These Terms & Conditions (“Terms”) govern your use of Restocarte (the “Service”), operated by Infinity Curve LLC (“Company”, “we”, “our”, or “us”), a company registered in Georgia. Paid subscriptions to the Service are sold and billed by Paddle.com Market Ltd, which acts as the merchant of record for those charges. By creating an account or otherwise using Restocarte, you agree to be bound by these Terms.
1. Service Description
Restocarte is a cloud-based platform that lets restaurants, cafés, bars and hotels publish a digital menu, share it through QR codes, table tags and embeddable widgets, and — optionally — accept orders and payments from their guests at the table.
The Service is provided to you as the business operating the venue. You are responsible for how the platform is used within your organisation, including by your staff, and for the accuracy and legality of everything you publish through it.
2. Account Registration and Security
To use Restocarte, you agree to:
- Provide accurate and complete account and business information
- Keep your sign-in credentials confidential, including the magic-link emails we send you
- Notify us immediately if you suspect unauthorised access or a security breach
- Ensure any staff you give access to the platform comply with these Terms
- Keep your account and billing information up to date
You are responsible for all activity that occurs under your account.
3. Your Content and Data
You retain ownership of everything you upload to Restocarte — your menu text, prices, images, branding and the records of orders placed at your venue. We do not claim any ownership of it.
You grant us a limited licence to host, reproduce and display that content for the sole purpose of operating the Service for you — for example, rendering your menu at its public address, generating QR codes and social preview images, and sending order notifications on your behalf. The licence ends when the content is deleted.
You are responsible for the accuracy of your menu, including prices, availability, and any allergen or dietary information you publish. Allergen labelling is a legal obligation in many jurisdictions and it rests with you, not with us. The allergen and dietary tags the platform offers are a presentation tool, not legal advice or verification.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes
- Attempt to bypass, disable, or interfere with security or rate-limiting features
- Upload malicious code or attempt to disrupt the platform or other users
- Share account access with unauthorised users, or resell the Service without our agreement
- Publish content you have no right to use, or content that is abusive, deceptive or offensive
- Reverse engineer, scrape at scale, modify, or create derivative works of the platform
Violations may result in suspension or termination of your access.
5. Subscription and Payments
Continued use of Restocarte requires an active subscription. By subscribing, you agree to:
- Pay all applicable fees for your selected plan
- Keep your billing information accurate and up to date
- Allow recurring automatic billing until you cancel
New accounts start with a free trial. When the trial ends without an active subscription, access to the management dashboard is suspended; your data is retained and access is restored as soon as you subscribe.
We may change pricing with at least 30 days' notice. Prices are shown in your local currency where supported and may include tax depending on your location.
Subscriptions are sold and billed by Paddle, our merchant of record. Paddle's name appears on your statement, Paddle issues your invoice, and Paddle is responsible for collecting and remitting any applicable VAT or sales tax. Your card details are handled by Paddle; we never see or store your full card number. Paddle's own terms and privacy policy apply to that transaction.
6. Guest Orders and Payments
Taking orders through Restocarte is optional, and how those orders are paid for is your choice per venue:
- Send to kitchen — the order reaches you by email and push notification and your guest pays you in person. No card payment passes through Restocarte and no platform fee applies.
- Pay upfront — your guest pays by card before the order reaches your kitchen.
- Pay at the end — your guest keeps an open tab across several orders and settles it before leaving.
For card payments from your guests, you are the seller and the merchant of record. You sell food, drink and other items to your guests directly; we are not a party to that contract, and we are not responsible for preparing, delivering or refunding what you sell.
Card payments are processed by Stripe using a Stripe Connect account you own and onboard yourself. Payments are taken as destination charges: the payment settles into our Stripe platform account and is transferred to your connected account automatically, less our platform fee of 1% of the order subtotal and less Stripe's own processing fees. We do not hold your funds beyond that automatic transfer, and we do not control your payout schedule — Stripe does.
Using card payments requires you to accept Stripe's Connected Account Agreement and to complete Stripe's identity and business verification. Stripe may suspend or restrict your ability to accept payments independently of us. Chargebacks, disputes and refunds on guest orders are your responsibility as the seller.
You can refund an order or a tab from your dashboard. A refund reverses the transfer to your connected account and returns our platform fee. Refunds of your own Restocarte subscription are handled by Paddle under its refund policy.
7. Service Availability
We aim to provide continuous, reliable access to Restocarte; however:
- We do not guarantee uninterrupted or error-free service
- Scheduled maintenance may occur, with notice provided where possible
- We may add, change or remove features at any time
8. Third-Party Services
Restocarte depends on third-party services to work — including Paddle for subscription billing, Stripe for guest payments, Resend for email, Firebase Cloud Messaging for push notifications to the mobile app, and error-monitoring and infrastructure providers.
Your use of those services is subject to their own terms and policies. We are not responsible for their reliability, availability or performance, and an outage at a provider may interrupt part of the Service.
9. Termination
You may cancel your subscription at any time from the billing page in your dashboard, or by contacting us. Cancellation takes effect at the end of the period you have paid for.
We may suspend or terminate access if you breach these Terms, if payment fails, or where we are required to by law.
After termination you have 30 days to export or request a copy of your data. After that period we may permanently delete it, except where we are required by law to retain records — for example, records of payments received.
10. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. We do not warrant that the Service will meet your requirements, or that it will be uninterrupted, secure or error-free.
To the maximum extent permitted by law, our total liability arising out of or relating to the Service in any 12-month period is limited to the subscription fees you paid us in that period. We are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of data. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence. If you are a consumer, your statutory rights are unaffected.
11. Governing Law
These Terms are governed by the laws of Georgia, and the courts of Georgia have exclusive jurisdiction over any dispute arising from them, except where mandatory law in your country of residence gives you the right to bring proceedings locally.
12. Changes to These Terms
We may update these Terms from time to time. When changes are material we will notify you by email or through the dashboard before they take effect. Continuing to use Restocarte after that constitutes acceptance of the revised Terms.
